Terms & Conditions

1. Definitions
In the following terms and conditions Full Bloom Nursery Ltd. is hereinafter called 'the company'.
2. Terms of Business
This Catalogue or trade lists cancel all previous lists;
Prices are subject to change without notice;
Prices do not include GST and freight
3. Supply
Sales will be made subject to these terms and conditions and the Terms of business specified in the trade catalogue current at the time of supply, and such other terms and conditions as may from time to time be specified by the company in writing.
4. Payments
Payments for goods supplied shall be due and payable on the 20th on the month following the date of the invoice ("the due date")
5. Interest for late payment
Interest calculated at the rate of 1.50% plus GST per month shall accrue on any part of the purchase price outstanding from the due date of payment together with all costs of collection incurred by the Company.
6. Delivery
(a) The Company shall not be liable for any loss, damage or deterioration to the goods during delivery to the Purchaser.
(b) The goods shall be at the sole risk of Purchaser from the time the Company notifies the Purchaser that the goods are available for collection or delivery.
(c) The company shall not be liable for any loss caused by the late delivery of the goods because of crop failure, disease affecting the goods, Government or local authority regulation to order preventing supply, Act of god or negligence of the company and its servants.
(d) All goods are dispatched uninsured and at buyers risk. Any complaints or shortages to be lodged within seven days of receipt of goods. Loss or damage in transit to be made to last carrier.
7. Representation
The Company takes the greatest care to have all trees, plants, seeds, etc. sold by them to be of merchandable quality and to be true to name and description but any express or complied conditions, statement or warranty whether arising by statute or common law or otherwise as merchandable quality or name or description is hereby excluded. The Company does not undertake to replace failures or be responsible for the crop.
8. Conditions of sale
Grades quoted are estimated only: confirmation of supply / delivery date will be returned as soon as possible after receipt of order. The Company cannot be responsible for shortages at dispatch, due to unforeseen circumstances.
9. Ownership
All goods sold by the Company shall remain the property of the Company until payment is made in full including any goods and services tax. (each order being considered as a whole).
10. New Accounts
New customer must pay cash or payment by cheque with their new orders until a credit rating is established. To become a credit customer and be eligible to pay invoice; we require that you complete our credit application form and supply three credit references and our right to contact any of those referees for details your credit history.
